13 GROUNDS WHY ODUAH SHOULD BE PROSECUTED - FEMI FALANA

Popular Lagos Lawyer, Femi Falana (SAN) states 13 grounds why Stella Oduah should be prosecuted.

Firstly, he accused the House of Reps committee before whom Oduah appeared of delibrately not asking her the relevant questions on the "criminal enterprise".

He also stated that illegal transactions had established, among others, that in actual fact there was no appropriation for the sum of N255m for purchasing armoured cars in the Appropriation Act, 2013.

Mr. Femi Falana also stated that she exceeded her limit of approval as only the Federal Executive Council has the capacity to approve N100m and above, and that the transaction did not comply with the Public Procurement Act provisions.

Other grounds include, "The inflation in the prices of the two cars by Coscharis in participation with Stella and the management of the NCAA.

The loan of N643m from the First Bank of Nigeria was not approved by the National Assembly.

The repayment of the loan in 3 years by the NCAA is synonymous to contract splitting in contravention of the financial guidelines of the FG.

That the Aviation Minister admitted her involvement in  the extra budgetary purchase of the cars when she gave illegal approval.

The Media Assistant to the Aviation minister has not denied his claim that the armoured cars were purchased purchased for his boss.

The Ministry of Aviation conspired with Coscharis to equivocate payments of appropriate duties on the armored cars to the coffers of the FG as they obtained duty waivers by false pretences from the Federal Ministry of Finance.

He further stated that First Bank entered into an illegal loan agreement with the NCAA to finance illegal transaction from revenues of the NCAA. Under the law, loans are only approved by the Legislative arm of government. to fun capital projects not for car purchases.

He therefore urged the EFCC to hasten to try the minister and he agents for gross economic and financial crimes as they wilfully violated the relevant provisions of the constituiton, the Public Procurement Act as well as the relevant Circulars and Financial Guidelines of the FG.
